However, Senior U.S. District Judge Donovan Frank denied xAI's emergency request, citing the company's delay in filing the challenge. Judge Frank noted that xAI waited nearly three months after the law was signed in May to file its lawsuit, and only three days before its effective date. He concluded that "such a delay in bringing the action and the motion suggests that harm is not immediate." This ruling is considered a narrow procedural loss for xAI and not a final judgment on the merits of the case. A hearing for a preliminary injunction, where xAI will have another opportunity to argue for the law's suspension during the ongoing legal process, is scheduled for August 19.
